However, information regarding your Internet browsing history is not monitored, recorded, logged, stored, or passed to any third party. If it is necessary to pass any information to a third party as it relates to providing the Services, for example, resolving a DNS query using a third-party DNS resolution service, we will do so, however, we will not monitor, record, log, or store that information, for example, the information contained within the DNS resolution.

Limiting personal information that we collect and share
You may take certain actions to limit our access to personal information collected through our Sites, including IP address and referring website. You may opt-out of receiving many behavioral ads through a web tool available here. You can also opt-out of the use of this information for analytics through Google Analytics here. You can also browse our Sites using a browser private mode, which may prevent us from collecting information about you and your browser.
Requesting copies of your personal information or asking that we delete your personal information
If you have provided your personal information to receive Service, entered personal information through a form on our website, or have given us personal information in other ways, you can request a copy of the personal information about you that we currently hold and you can request that we delete this information.
When you make a request, we will collect four basic pieces of personal information, which we will match with our records to reasonably verify your identity. After you submit the form, you will receive an email confirmation with instructions on an additional step that we require you take to help verify your identity and email address. We endeavor to respond promptly to your request once we reasonably verify your identify. Note that if you request your personal information more than twice in a twelve-month period, we may be unable to respond. And rest assured, we do not discriminate against any consumer who makes these requests.
If we are unable to verify your identity, we may not respond to your request. Because we cannot validate the identity of visitors to our website, we are unable to share a copy of your personal information or delete your personal information that we have from you if you have only visited our website. We comply with special legal requirements for California residents associates with access, deletion, and sale or sharing of residents’ data and application of do not track notices.
“Do Not Track” notice
Currently, there is not a universal “Do Not Track” protocol that exists. As such, our Services and website will continue to operate whether or not a “Do Not Track” signal is received.
California Consumer Privacy Act (“CCPA”)
CCPA Personal Information (“CCPA PI”) is defined by the state of California as information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with California consumers or households. You have the right to request information from us regarding the information we have collected or shared, for what business purpose it was collected or shared, and to which categories of third parties it was shared. You also have the right to request the deletion of your CCPA PI. Indemnification
You agree to defend, indemnify, and hold harmless Aerwave, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees, including reasonable attorneys’ fees, arising out of or relating to your violation of these Website Terms of Use or your use of the Website, including, but not limited to, any use of the Website’s content, services, and products other than as expressly authorized in these Website Terms of Use, or your use of any information obtained from the Website.
Arbitration
YOU AND AERWAVE, INC. ARE AGREEING TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY, OR TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO A CLAIM. OTHER RIGHTS THAT YOU WOULD HAVE IF YOU WENT TO COURT MAY ALSO BE UNAVAILABLE OR MAY BE LIMITED IN ARBITRATION.
ANY CLAIM, DISPUTE, OR CONTROVERSY (WHETHER IN CONTRACT, TORT, OR OTHERWISE, WHETHER PRE-EXISTING, PRESENT, OR FUTURE, AND INCLUDING STATUTORY, CONSUMER PROTECTION, COMMON LAW, INTENTIONAL TORT, INJUNCTIVE AND EQUITABLE CLAIMS) BETWEEN YOU AND US ARISING FROM OR RELATING IN ANY WAY TO THESE WEBSITE TERMS OF USE WILL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION.
(a) The arbitration will be administered by the American Arbitration Association (“AAA”) in accordance with the Consumer Arbitration Rules (the “AAA Rules”) then in effect, except as modified by this Arbitration Agreement section. (The AAA Rules are available at www.adr.org/arb_med or by calling the AAA at 1-800-778-7879.) The Federal Arbitration Act will govern the interpretation and enforcement of this section and any arbitration between us.
The arbitrator will have exclusive authority to resolve any dispute relating to arbitrability and/or enforceability of this arbitration provision, including any unconscionability challenge or any other challenge that the arbitration provision or the agreement is void, voidable, or otherwise invalid. The arbitrator will be empowered to grant whatever relief would be available in court under law or in equity. Any award of the arbitrator(s) will be final and binding on each of the parties and may be entered as a judgment in any court of competent jurisdiction.
We will be responsible for paying any individual consumer’s arbitration fees to AAA. If you prevail on any claim that affords the prevailing party attorneys’ fees, the arbitrator may award reasonable fees to you under the standards for fee shifting provided by law.
(b) You may elect to pursue your claim in small-claims court rather than arbitration if you provide us with written notice of your intention to do so within 60 days of your purchase. The arbitration or small-claims court proceeding will be limited solely to your individual dispute or controversy.
(c) You agree to an arbitration on an individual basis. In any dispute, NEITHER YOU NOR AERWAVE, INC. WILL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS BY OR AGAINST OTHER CUSTOMERS IN COURT OR ARBITRATION OR OTHERWISE PARTICIPATE IN ANY CLAIM AS A CLASS REPRESENTATIVE, CLASS MEMBER OR IN A PRIVATE ATTORNEY GENERAL CAPACITY. The arbitral tribunal may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding. The arbitral tribunal has no power to consider the enforceability of this class arbitration waiver and any challenge to the class arbitration waiver may only be raised in a court of competent jurisdiction.
If any provision of this arbitration agreement is found unenforceable, the unenforceable provision will be severed, and the remaining arbitration terms will be enforced.
(d) The arbitration shall be heard by one arbitrator, chosen by agreement of the parties. If the parties fail to agree on an arbitrator within 30 days of the commencement of the arbitration, the arbitrator selection mechanism in the AAA’s Consumer Arbitration Rules shall apply. The place of arbitration shall be Montgomery Country, Texas unless the parties agree in writing to a different location. Regardless of where the arbitration proceeding actually takes place, all aspects of the arbitration and the Agreement shall be governed by the provisions of the laws of the State of Texas (except if there is no applicable state law providing for such arbitration, then the Federal Arbitration Act shall apply) and the procedural and substantive law of such state shall be applied without reference to conflict of law rules. The award of the arbitrators shall be accompanied by a reasoned opinion. Except as may be required by law or to enforce an award, neither a party nor an arbitrator may disclose the existence, content, or results of any arbitration hereunder without the prior written consent of the parties to this Agreement.
The parties to this Agreement acknowledge that by agreeing to this arbitration provision, they are giving up the right to litigate claims against each other, and important rights that would be available in litigation, including the right to trial by judge or jury, to extensive discovery and to appeal an adverse decision. The parties acknowledge that they have read and understand this arbitration provision, and that they voluntarily agree to binding arbitration.
Waiver and Severability
No waiver by Aerwave of any term or condition set out in these Website Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Aerwave to assert a right or provision under these Website Terms of Use shall not constitute a waiver of such right or provision.
If any provision of these Website Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Website Terms of Use will continue in full force and effect.
Entire Agreement
The Website Terms of Use and our Privacy Policy constitute the sole and entire agreement between you and Aerwave, Inc. regarding the Website and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Website.
