Promotion Terms and Conditions

These Terms and Conditions (the "Terms") entered into by and between you and Aerwave, Inc. ("we", "us", "our" or "Aerwave"), apply to the promotional offer (the "Promotion") are governed by the Terms of Service between you and Aerwave and together with the Terms of Service (collectively, the "Agreement"), govern your access to and participation in the Promotion. Capitalized terms used in these Terms that are not defined in these Terms will have the meanings set forth in the Agreement. By accessing or participating in the Promotion, you confirm that you have read, understood and accept the Agreement, and you will be legally bound by any and all of the terms and conditions of the Agreement regardless of your location or nationality. If you do not agree to be bound by the Agreement, do not access or participate in the Promotion.

About the Promotion. This Promotion is temporary and is only active for the duration described in the promotional offer (“Promotion Period”). Aerwave may modify or replace any part of these terms and conditions without notice at any time in our sole discretion.

Eligibility Requirements. You understand and agree that the Promotion is subject to the following requirements:

  • you are required to be a new Aerwave customer and create an Aerwave account;

  • you must remain a subscriber to the Service in good standing for the duration of your subscription to Aerwave, if you or Aerwave terminates your subscription earlier, Aerwave may charge you an amount equal to any discounts you received under this Promotion;

  • you must be a resident in the location of service designated in the Promotion;

  • each member account may only participate in the Promotion once;

  • this Promotion is not available to existing Account holders; and

  • you may not participate in the Promotion if you are less than 18 years of age.

Other Terms. By participating in the Promotion, you agree and acknowledge that:

  • Promotion will apply at checkout with the Promo Code used;

  • Promotion not valid for prior purchases;

  • we may terminate your right to participate in the Promotion if, in our sole discretion, we determine you have violated the Agreement, including behaving in a manner that is prohibited, such as fraudulent registration, failing to provide required information, including identify verification, or otherwise abusing the Promotion;

  • your participation in the Promotion is subject to third party terms and conditions that is beyond our control, and such third party may prohibit your participation in the Promotion;

  • we are not responsible for any losses resulting from your inability to participate in the Promotion or any losses resulting therefrom. We will not be liable for any losses resulting from your own fault or error, including you providing incorrect information as requested under the Promotion;

  • you are responsible for any taxes incurred from your participation in the Promotion, if any;

  • Promotion cannot be redeemed for cash or cash equivalent;

  • Promotion cannot be combined with other promotional offers;

  • Aerwave may refuse or cancel orders due to promo and pricing errors, fraud, misuse, or unauthorized use; and

  • supplies of this promotion may be limited and Promotion is only valid while supplies last.

Disclaimer We reserve the right to revoke the Promotion or change these Terms at any time without notice. The Promotion shall be void where prohibited by law applicable to you or us. We, or any third party we partner with to offer the Promotion, may reject your participation in the Promotion and deny any rewards associated with the Promotion on the grounds of suspicion or abuse of the Promotion without providing any explanation.
